CALL TO ORDER AND INTRODUCTIONS
Chairman Kevin Woolbright called the regular monthly meeting to order at 9:30 am followed by the customary introductions. There were 37 attendees at the meeting.
The minutes of June 23, 2015 were approved as written.
Will Gooch (Decisive) thanked USIC (Joe Feronti) and UtiliQuest (Mike Burns & Erik Phillips) for their quick response to work site issues and for being “on point”.
OPEN DISCUSSIONS REGARDING DAMAGE PREVENTION AWARENESS & COOPERATION
Will Gooch stated Decisive is having issues with Verizon using Clear/No Conflict on Ticket Check when there are peds on the work sites. Dora Parks (Miss Utility) suggested that if contractors see clear evidence of underground Verizon plant they use the Ticket Check Discrepancy notice on a valid ticket. This notice will be transmitted to Verizon allowing them to review the ticket information and to revise the Ticket Check code when necessary.
Jim Barron (Maryland Authority) stated that PHMSA finished their rule making for the 9 Pipes Act and included a new Section 198. If a state does not provide enforcement in their damage prevention law and a contractor hits a pipeline, PHMSA will provide the violation enforcement stating at $20,000.
Kevin Woolbright (WSSC) stated he does not manage contracts for WSSC and is not able to assist with issues regarding any contract matter or contract locating issue. For reference, Deena Joyce is the point of contact.
Jeff Delcamp of MES provided information on a new project in the Foot Smallwood area of Anne Arundel County. The project will consist of 110 soil borings that will start in late August and continue for seven months. Mr. Delcamp provided a slide presentation of the work area and asked to meet the utility members and contract locators that would impacted by this project. The project will start with Designer tickets and include private locating for the Maryland Port facilities, the affected utility companies will locate and identify what they own and maintain. Mr. Delcamp will attend future DPC meetings to keep the group abreast of the progress.
PRESENTATION; SAFETY AND EDUCATION
Joel Knopfmacher (Howard County) provided a power point presentation on the importance of hydration; what to drink, when to drink, signs of dehydration, how to recognize and treat heat exhaustion and heat stroke. The members agreed the presentation was a benefit to better understand this safety aspect regarding employees.
Will Gooch will provide the safety presentation for the August DPC meeting.

The next full committee meeting is scheduled for October 8th in western Maryland.
The Subscriber Committee and Board of Directors are active participants with the Maryland Authority regarding Title 12 Law modifications for a future rewrite.
STEERING COMMITTEE TO REWRITE THE DISTRICT OF COLUMBIA ONE-CALL LAW

Dora Parks (Call Center Committee Member) reported the committee had met a total of 44 times with the latest meeting being held on July 23rd. There was a general discussion regarding the impact of the new approach by PHMSA (Section 198) on the District of Columbia. The committee continues to review each section of the Title 34 draft for sufficiency and grammar. Joe Shelton (Contractor Committee Member) shared information regarding having an 18 and 24 inch no mechanized equipment tolerance zone.

MARYLAND UNDERGROUND FACILITIES DAMAGE PREVENTION AUTHORITY

Executive Director, Jim Barron provided the following report;
The Authority had a review of one NPV for No Ticket & Duty of Excavator at their July 8, 2015 Meeting.
14 New NPV’s currently under investigation
Oral Arguments for NPV# 283 on the Constitutionality of the Authority were heard in
front of the Maryland Court of Special Appeals on Friday, April 10, 2015. The court rendered a decision in favor of the Authority. The complainant has since filed a Writ of Certiorari with the Maryland Court of Appeals. The Authority filed an Opposition to Petition for Writ of Certiorari on June 15. It’s up to the Court whether they will hear the case or not
NPV’s 316a, 316b, 408, 411a, & 411b were appealed to the Circuit Court of Anne Arundel County. A favorable report on that appeal has been appealed to the Maryland Court of Special Appeals. Oral Arguments are set for October 2015
NPV’s 1216 ($2,000), 1834 ($2,000), 1841 ($2,000) and 1853 ($2,000); all for mis-mark/no-mark had hearings at the February 4, 2015 Authority Meeting. The decision of the Authority on those NPV”s has been appealed to the Circuit Court of Anne Arundel County.The probable violator’s attorney has filed a PIA Request. The Authority is currently working with that attorney to satisfy that report.

The Authority will be working the Miss Utility Booth at the MACo Summer Conference on August
12th through the 15th.
Notices will be going out in late summer or early fall to establish a re-write committee to take a
look at Title 12 and establish re-write legislation to be submitted to the Maryland Legislature in the 2017 Legislative Session
The Authority will be moving into new office effective 8/1/15.
LOCATOR ACHIEVEMENT AWARDS (LAA) AND DIG SMART AWARDS (DSA)

Emily Meir reported the 2015 Dig Smart Awards entry deadline is July 31st. The committee will review them during the August 25th meeting to make a decision on the winners. Dig Smart winners will be recognized during the GCDPTC in Ocean City, MD.

2015 GREATER CHESAPEAKE DAMAGE PREVENTION TRAINING CONFERENCE (GCDPTC)

Dora Parks reported the 2015 GCDPTC will be held during October 27-30, 2015 at the Clarion Resort in Ocean City, MD. Early Bird registration is underway and regular registration starts on September 5th. The meals, networking and registration sponsorships have been secured, to date we have 24 sponsors and 29 exhibitors. Registration is up by 23%.
WSSC has produced the pre-conference program guide available for distribution after our meeting.

DAMAGE PREVENTION EVENTS
Our next Miss Utility event is scheduled for August 22nd at the RFK Stadium. DC United will host a Damage Prevention Awareness game night. This event will reach our Spanish contractor damage prevention partners. Over two hundred contractors will be invited to a DC United game that will include a meal, various displays, educational and promotional give-a-ways and a DC United soccer scarf. MGH provided a flier outlining the event as a handout.
