Minutes of the meeting held on June 23, 2015

CALL TO ORDER AND INTRODUCTIONS
Chairman Kevin Woolbright called the regular monthly meeting to order at 9:35 am followed by the customary introductions. There were 30 attendees at the meeting.
The minutes of May 26, 2015 were approved with one spelling correction on page 4.
Dora Parks (Miss Utility) reiterated that OCC has been involved in some new outreach efforts this year. Among other endeavors, OCC’s Jimmy “The Bike Wrangler” Jennings & the 811 Bike will “guest star" on an episode of ‘Hunting in the Sticks’ staring Mark Stowe and airing on Wednesday, July 22nd. The Pursuit Channel is channel 604 on Direct TV and channel 393 on Dish Network. OCC will sponsor several other episodes during the summer and fall months promoting call before you dig.
OPEN DISCUSSIONS REGARDING DAMAGE PREVENTION AWARENESS & COOPERATION
Will Gooch (Decisive) reported locating issues within certain areas of their excavation work sites. Will plans to meet with the affected locators to resolve the issue and will report back during the July meeting. Will stated Eric Phillips and Mike Burns (UtiliQuest) have provided excellent response and support to the Decisive tickets.
Pam March (SMECO) stated that UtiliQuest is not marking the Verizon underground lines and inquired why. Pam stated that Ticket Check is providing a clear/no conflict status for Verizon on several of their tickets, yet the work site has clear evidence of underground lines.
Dora Parks (Miss Utility) explained the recent Verizon changes regarding ticket transmission and response and suggested that if contractors see clear evidence of underground Verizon plant they use the Ticket Check Discrepancy notice on a valid ticket. There was much discussion regarding this issue that included possible violations of Title 12, Maryland law. The contractors in the room were extremely disenchanted that there work is being held up due to Verizon’s new processes and response to Ticket Check.
Lawrence Johnson (Pinpoint) inquired about how the Authority assigns Notice of Probable Violation numbers. Jim Barron (MD Authority, ED) stated the numbering was contingent upon the claim and number of tickets within a claim. The assigned numbers provide order during the Authority review process.
No reports of new business.
PRESENTATION; SAFETY AND EDUCATION
Dora Parks provided information on keeping cool during these hot days of summer, especially for those working outside and enclosed in cab equipment. Reminders included making sure folks have plenty of drinking water and take additional breaks. Look out for signs of heat fatigue and move those affected to a shaded area or air conditioned setting. Apply cool compresses to the back of the neck and other pressure points.
Other utility owners chimed in on what they provide during possible heat stress days; shut down jobs, reduce hours, respond to emergencies only, provide Gatorade and additional drinks.
Cal Brooks (Howard County) stated he would provide the July safety presentation.

Dora Parks provided the following update for the Miss Utility of Maryland and Washington, D.C. first annual scholarship program.
Miss Utility provided five graduating high school students from across Maryland scholarships to help them pursue a career in construction or another related industry that requires excavation at a two-year or four-year college, university or technical school. These students will each receive a $1,000 single-year scholarship and were selected based on essays that demonstrated their desire to work in the industry and a deep understanding of why it is important to contact 811 before digging for projects in their future careers.

The second annual Miss Utility Scholarship Program will open on Tuesday, August 11, 2015.
The next full committee meeting is scheduled for October 8th in western Maryland.
The Subscriber Committee and Board of Directors are active participants with the Maryland Authority regarding Title 12 Law modifications for a future rewrite.
STEERING COMMITTEE TO REWRITE THE DISTRICT OF COLUMBIA ONE-CALL LAW

Committee member, Dora Parks reported the committee had meetings on June 9th and the 24th. The committee is reviewing each section of the Title 34 law draft for completeness, grammar and format. The focus of the committee is to at least meet PHMSA’s Nine Key Elements for an effective damage prevention program while aligning the District’s damage prevention program with CGA’s Best Practices.

MARYLAND UNDERGROUND FACILITIES DAMAGE PREVENTION AUTHORITY-Maryland Authority

Executive Director, Jim Barron provided the following report;
The Authority had hearings on 19 NPV’s for Abuse of Emergency Calls at their June 3, 2015 Meeting.
Oral Arguments for NPV# 283 on the Constitutionality of the Authority were heard in front of the Maryland Court of Special Appeals on Friday, April 10, 2015. The court rendered a decision in favor of the Authority. The complainant has since filed a Writ of Certiorari with the Maryland Court of Appeals. The Authority filed an Opposition to Petition for Writ of Certiorari on June 15. It’s up to the Court whether they will hear the case or not.
NPV’s 316a, 316b, 408, 411a, & 411b were appealed to the Circuit Court of Anne Arundel County. A favorable report on that appeal has been appealed to the Maryland Court of Special Appeals. Oral Arguments are set for October 2015
NPV’s 1216 ($2,000), 1834 ($2,000), 1841 ($2,000) and 1853 ($2,000); all for mis-mark/no-mark had hearings at the February 4, 2015 Authority Meeting. The decision of the Authority on those NPV”s has been appealed to the Circuit Court of Anne Arundel County
The Authority has a Business Meeting Only scheduled on Wednesday July 8, 2015. The following Authority Members will be seated at that meeting:

LOCATOR ACHIEVEMENT AWARDS (LAA) AND DIG SMART AWARDS (DSA)

Committee member, Dora Parks reported the 2015 Dig Smart Awards is underway. The committee is meeting today (June 23rd) to review the self-nomination Dig Smart form that will be delivered to contractors in the service area of Miss Utility about July 8th. The entry deadline is July 31st.

2015 GREATER CHESAPEAKE DAMAGE PREVENTION TRAINING CONFERENCE (GCDPTC)

Committee member, Dora Parks stated the 2015 GCDPTC will be held during October 27-30, 2015 at the Clarion Resort in Ocean City, MD. Early Bird registration started on May 16th with a savings up to $50.00 on some conference packages. Regular registration starts on September 5th. A promotional conference video in addition to conference information is available at www.missutilityconference.com.
The committee is very excited about the key note speaker, Shane Bush who will provide a safety message about reducing human error in a humorous way. Shane works as an Adjunct Professor at the University of Idaho, facilitating graduate level courses in Behavior Based Safety, Human Performance Fundamentals and Human Error Investigation. Shane has been involved in developing and overseeing a University of Idaho 15 credit Human Performance Graduate Certificate program as well. Shane spent more than 15 years in the field of Radiological Control at numerous commercial Nuclear Power Plants and the Department of Energy experiencing all aspects of human error.

DAMAGE PREVENTION EVENTS
Our May 30th first ever, Touch A Truck event was a community hit. Our Miss Utility stakeholders displayed 35 construction vehicles and heavy work equipment. The kids enjoyed climbing into the equipment cabs, blowing the horns and talking to the operators about what the trucks and equipment do on work sites. There was face painting, lots of free give-a-ways and good ole trucker music played during the event. Game ticket holders received free kids Touch A Truck t-shirts and our special ticket holders received free kiddie park tickets. Huge success for our first event of this kind, over 6,000 in attendance.
Our next Miss Utility event is scheduled for August 22nd at the RFK Stadium. DC United will host a Damage Prevention Awareness game night. This event will reach the Spanish speaking contractor damage prevention partners. Three hundred contractors will be invited to a DC United game that will include a meal, various displays, educational and promotional give-a-ways and a DC United soccer scarf.
