Minutes of the Maryland and DC Damage Prevention Meeting

Kevin Woolbright called the regular monthly meeting to order at 9:30am.

Opening Comments
Kevin Woolbright reiterated the monthly meeting purpose and protocol; an environment of problem resolution, shared information (state law, events, trade shows, awards, call center initiatives, etc.) and damage prevention discussions.  Professionalism and respect should be demonstrated at all levels. Kevin also established the policy and purpose of the meeting gavel for everyone’s understanding. 

Customary introductions were made.

The Minutes of March 26, 2013 were approved as written.

In recognition of National Safe Digging Month observed each April, the following campaigns were initiated;

  • Mid Atlantic Sports Network (MASN) texting campaign to 40,000 subscribers, will receive the following message while getting game updates, “Miss Utility, call 811 before you dig”
  • Radio campaign continues with a reminder of who an excavator is and their responsibilities to safe digging and damage prevention.
  • Minor League Baseball, Frederick Keys for Reading Sponsorship.  WSSC staffed the Miss Utility booth for the April 5, 6 & 7th games. Verizon will handle the booth for the May 10, 11 and 12th games.
  • Governor O’Malley signed the Miss Utility Proclamation for the Safe Digging Month, April 2013.
  • Miss Utility DVD campaign, a mass mailing of information to include a copy of the damage prevention DVD recreated for the 2010 law change was mailed to 600 area contractors.
  • BGE’s Sunday Morning Gardening episode (aired April 14th) included information regarding the importance of calling Miss Utility before any digging project.
  • A new Gold sponsorship for 2013 included the “Paycheck Tournament Series”. There will be 30 bass fishing tournaments in 2013 where Miss Utility will have a strong presence. Tournaments include 20 to 30 boats with lots of on-lookers for the weigh-ins.  Team championships are held in Syracuse, NY.

Dora Parks (Miss Utility) provided an overview of the 10th Locator Achievement Awards Banquet

  • 40 Locators in Western Shore Maryland and DC have been nominated for their partnership in damage prevention from January 1, 2012 to December 31, 2012. During this period they have not had any at fault damages or at fault vehicle accidents in addition to providing exceptional communication skills, a commitment to accurate locating, on time performance and public safety.
  • A ‘family style’ banquet will be held on Friday, May 10th at the Prince George’s stadium starting at 5:30pm, complete with awards, stadium recognition, great food and desserts, play-land passes for the children, a baseball game, door prizes, attendee gifts and fireworks.
  • Anyone wanting to attend the banquet can talk to an Awards Committee member (Mark Hamrick, Wayne Gilmer, Danielle Davis, Chris McMurry, Kevin Woolbright or Dora Parks).

Completed Presentations

Kevin Woolbright discussed the training format; contact Dora Parks to complete a training request form and schedule a training date and time.  Dora will email the training schedule using a distribution email list that consists of utility owner-members, MOSH, contract locators and other interested parties.  It is requested that each training include area facility owners (Gas/Electric/Pipelines, Communications, Water/Sewer, MOSH and the call center. This team approach will provide the very best training as each person has the opportunity to share all things regarding their utility.  Training consists of using a power point presentation for talking points and providing educational and promotional Miss Utility items. Pictures, when provided are posted on the Miss Utility Face book page.

    Mark Hamrick (Verizon) stated vocational school Damage Prevention training started in 2012 as a result of a 100 pair Verizon line damage, no ticket was called in by the school for their home building excavation. Many vocational schools offer multiple contractor skill types of training which include excavation. Schools in many cases are not educated on the Maryland state laws regarding digging. The Verizon vocational school training was well received and opened doors to extend the training to other schools in the Maryland and DC areas.  Mark thanked MGH for their letter campaign to reach area vocational schools to educate them on the importance of calling Miss Utility prior to digging and to schedule Damage Prevention and Safe Excavation training via the Miss Utility DP training team.

    To date, the following companies have participated in the vocational school training; Verizon, Miss Utility Call Center, BGE, Elkton Gas, WGL, Columbia Gas and UtiliQuest.

    John Clementson (PSC) stated the training was well received, he received positive comments and the attendees benefited from the Damage Prevention training session.  John recommended this level of training to everyone, it is free and important for education and damage prevention.

The attendees of this training class stated they learned a great deal about the Maryland state law regarding notification, call center practices, on site clear evidence and safe excavation.  They greatly appreciated the time we spent with them and will invite the team back for other department training.

Chairman, Matt Ruddo (One Call Concepts)

Chris McMurry (MGH) reported the following conference update;

  • The GCDPTC will be held on October 23 – 25, 2013 in Ocean City, MD at the Clarion Conference Center Hotel.
  • Registration opened in mid-April.
  • Matt Eversmann will be the keynote conference speaker.  Matt will talk about his experience in Somali during the 2013 battle of Mogadishu; how quickly events can change and how to respond and react to adversity in highly stressful times.
  • The Golf tournament will be held on Wednesday morning.
  • Evening events are being planned for Tuesday night conference attendees.

Dennis Lescalleet (Pleasants Construction) stated he attended the CGA National Conference in March and commented that our annual regional conference offered informative break-out sessions, an inviting and hospitable exhibit floor, dramatic key note speakers, good food and an easily affordable conference price.  Dennis rated the GCDPTC excellent compared to the national conference. All agreed, we do it well on a regional level.

The next conference committee meeting is scheduled for April 23rd.

The GCDPTC will be held on October 23, 24 & 25th in Ocean City, MD at the Clarion Resort Hotel and Conference Center. Conference surveys revealed that attendees preferred Ocean City for this annual conference.  The Clarion hotel has made many renovations for the comfort of conference registrants.

Matt Eversmann, featured in the film Black Hawk Down, will be the keynote speaker for this year’s conference. Save the date post cards will be produced and mailed out in the near future. Registration will start in mid-April for returning conference attendees, early bird registration in June and regular registration in August.

The committee continues to work on new and educational conference break-out sessions in addition to some fun events.

Next committee meeting is on March 26, 2013.

The last Authority meeting was held on April 3rd
The $250.00 claim fee has been waived from January 1st to June 30th 2013
Claims can be submitted at, www.mddpa.org
Disputes should first be brought to the Damage Prevention Committee Meeting for resolution
To date, (4) Probable Violations have been reviewed resulting in heavy fines for two claims
Hearings are scheduled for the June 2013 meeting
All hearings will be recorded and testify under oath
Jim visited Richmond, VA to audit the VA claim and hearing process
(14) Notice of Probable Violations (claims) will be reviewed at next Authority meeting
The new Authority is compliant to the Federal Pipes Act
Fines are being structured as follows,
$2,000.00 per violation
$4,000.00 for no call and second same type of fined violation
It is important to complete the claim form with accuracy for review by the Authority
In order to file a claim, the claimant should know the Maryland state law and its impact

Next Authority meeting is scheduled for May 1st.

Kevin Woolbright stated the Subscriber Committee meets every quarter to discuss the advertising budget, educational campaigns, call center matters, various reports and state holder issues. They are currently working to re-structure the By Laws for the Subscriber committee and the Damage Prevention committee.

Next meeting is scheduled June 18th at the call center. All call center Subscribers (utility owner-members) are invited to attend.

Dora Parks provided updated information on the Ticket Check - Excavator Codes,
            Code 6, Locate Discrepancy (for member codes 1, 2 or 9)
            Code 7, Not Complete/In Progress Dispute (for member code 5)

Contractor codes 6 and 7 are now available on Search and Status (www.missutility.net).

For a Locate Discrepancy;
If the ticket is not locked/expired and the status code is currently a 1 (clear/no conflict), 2 (marked) or 9 (marked up to privately owned utility) on any district code, there will be a box for the user to select to request the Discrepancy for the district code.  The user will be prompted to enter their email address.  An email will be sent to the user from ticketcheck@managetickets.com with a link to process the Discrepancy.  Until the user successfully clicks the link in the email, the Discrepancy will not be processed and sent to the member.

For a Dispute code:
If the ticket is not locked/expired and the status code is currently a 5 (not complete/in progress), on any district code, there will be a box for the user to select to request the Dispute for the district code.
The user will be prompted to enter their email address.  An email will be sent to the user from ticketcheck@managetickets.com with a link to process the Dispute.  Until the user successfully clicks the link in the email, the Dispute will not be processed and sent to the member.

Mark Hamrick emphasized that all contractors should use the Locate Discrepancy code while evaluating the work site prior to excavation for clear evidence. If there is evidence of a utility and the code is clear, a Locate Discrepancy should be submitted. If the utility states they have marked and there are no marks on site, again file the Locate Discrepancy.

DCI was recognized for going one year without any at fault damages for all of their (16) locators. The Subscribers Committee provided a beautiful walnut plaque describing DCI’s contribution to damage prevention by this company wide achievement.  Mark Hamrick presented the plaque to members of DCI.

Marc Haines (BGE) stated that BGE forwards a letter and offers free training to anyone damaging a BGE facility for at faults and/or no call. If there is a second occurrence by the same company, a second letter is sent, registered - suggesting the company contact the Miss Utility Damage Prevention Training Team for training.

Kathy Riley (Absolute Underground) stated BGE locators in Howard County either use code 4 (48 hour delay) or code 5 (Not Complete/In Progress, the locator has spoken to the excavator and they have agreed to this message) and there is no follow up by the locator.  These non-locates are holding up work and costing money.  Roger Trotter (Riggs Distler) agreed this was an issue for them as well.  Kevin Woolbright suggested these two contractors talk to BGE and their contract locating company and report back to the committee at the May meeting how the issue was resolved.

Mitzi Ambush (PEPCO) stated there was a scaffold matter with Long Fence that was resolved.  She also stated Dora Parks assisted her to resolve a DC ticket grid matter where a utility owner-member was not being notified.  The processed ticket did not provide all affected grids for the excavation.

Dora Parks provided an update of ITIC 2.0 training for Maryland and DC. To date, (6) site trainings have been completed and (11) more are scheduled.

There being no further business brought before the committee, the meeting was adjourned at 11:35am.
