PURPOSE OF REWRITE
To modify the current District of Columbia One-Call Law, Title 34 “Public Utilities”; Subtitle 7, Chapter 27 to meet the requirements of PHMSA’s Nine Key Elements of an effective damage prevention program and to reflect best and current practices. Enforcement of the DC law will have its foundation in outreach and education.
The 39th meeting of the Steering Committee was called to order at 9:00am by Chairman Brown.
Meeting minutes from April 15, 2015 were approved as written.
Chairman Brown made an announcement that Washington Gas will implement an enhancement to positive response in their footprint area for Maryland and the District of Columbia. Washington Gas will provide excavators processing tickets additional information for site markings to include a picture of the marked site, an orthophoto and a form for excavators to provide any questions and concerns regarding the marked site. Chairman Brown further explained that during the 2014 pilot in Montgomery County Washington Gas realized a reduction in gas damages. Early May is targeted to start providing this additional service to excavators.
Jim Barron, Executive Director of the Maryland Authority reported the Cross Bore bill was passed by both the Senate (SB #401) and House committees. It is anticipated the bill will be signed into law on October 1, 2015. The bill was changed to include both water and sewer services on the private site to include a tracer wire for full replacements and new installations.
Chairman Brown provided highlights of draft changes to the existing Title 34 law for the benefit of the committee; the draft is now aligned with PHMSA’s Nine Key Elements for an effective damage prevention program. Additionally, CGA Best Practices were considered for certain elements of the draft in addition other State damage prevention laws.
The committee continued discussions regarding the draft enforcement component regarding processes, membership and funding.
From this point, the draft will be thoroughly reviewed for sufficiency and format in preparation for review with the District’s General Council for the PSC, the Mayor and City Council and the Attorney General’s office.

The next committee meetings are planned for, May 7th and the 14th at the Miss Utility call center located at, 7223 Parkway Drive, Suite 100 Hanover, MD 21076. Refreshments will be available at 8:00am followed by the committee meeting, 8:30am to approximately 11:30am.
